Arbitration Procedures:

Claims will be heard by a single arbitrator. Arbitration will take place in British Columbia, Canada, but may be done remotely. The arbitration will be governed by the Federal Arbitration Act (FAA) and the laws of British Columbia, Canada. Any disputes about the enforceability of these terms will be decided exclusively by the arbitrator, not a court.

Opt-Out of Arbitration:

You may opt out of this arbitration agreement within 30 days of your first purchase by sending a written notice to Herbaco at 1383 Maple Bay Rd, British Columbia, Canada. The opt-out notice should include your name, address, and a clear statement that you do not wish to resolve disputes through arbitration. After the 30-day period, you must resolve disputes through arbitration.

Class Action Waiver:

You agree to bring any claims against Herbaco individually, and not as part of any class or representative action. The arbitrator will not consolidate claims or preside over class proceedings unless both parties agree. Any claim regarding the unenforceability of this waiver will be decided by a court, not an arbitrator.
